BRIEF BACKGROUND
At the outset , let me make it very clear that the President of India cannot take liberty of maintaining SILENCE OF LAMBS BUT need to have ROAR OF A LION FOR THE BENEFIT OF CITIZENS OF THE COUNTRY. PEOPLE OUT OF FEAR DO NOT COMMUNICATE THE MESSAGE THAT I AM DELIVERING AS REFERRED IN THE SUBJECT OF MY EMAIL. I do not have any thing more to lose when I am writing this email any more when the Govermment fo India has played a vital role in destroying a small family. .

The present development is over and above to my whsitleblowing of banking fraud in GTB for which the Department of Economic Affairs, FINANCE MINISTRY has failed to take prompt action inspite your intervention as communcaited to me vide File P1/C-84331.

IT IS ABSOLUTELY CLEAR THAT FINANCE MINISTRY THAT IS MR P CHIDAMBARAM IS OPENLY SUPPORTING CROOK SUSHIL HANDA AND HIS ADVOCATE SAURABH SOPARKAR EVEN WHEN GREAT BANK ROBBERY ARTICLE OF RS 750 CRORES WAS BROUGHT OUT IN INDIAN EXPRESS IN DECEMBER 2002.THIS IS EVEN WHEN TOP OFFICIALS OF FINANCE MINISTRY HAS IGNORED YOUR EXISTENCE CAN YOU AFFORD TO REMAIN SILENT AS PRESDIENT OF INDIA. ??? EVEN WHEN GTB HAS COLLAPSED THERE HAS BEEN NO ACTION ON MANGEMENT OF GTB AS WELL AS RAMESH GELLI OFGTB INSPITE OF HIS PROMISE IN LOKSABHA IN DECEMBER 2004 ???

THIS IS NOTHING BUT TIMIDITY ON THE PART OF PRESIDENT OF INDIA. . IT IS NOTHING BUT DISGRACE TO THE OFFICE OF PRESIDENT OF INDIA FOR ITS INACTION..

PURPOSE OF PRESENT EMAIL ;



It is necessary that the the administration , the judiciary develops thirst for truth and sense of unrgency so that a person and his family does not suffer as well as prevent more damage to him and his family. Let me draw your attention to the following information:-

I have once again received notice from Tax Recovery officer vide his letter dated 6-1-2005 from a new Tax Recovery officer . The text is as the link annexed herewith.

Till date the predecessor Tax Recovery Officer as well as the current Tax Recovery Officer has not given any reply.

Now tell me Your Excellency, how the Present Tax Recovery Officer DARE TO ISSUE NOTICE IN THE FIRST PLACE before furnishing a detailed reply of the predecessor Tax Recovery Officer and the actions taken by him as conveyed to him.

Why should I be made to go through agony .? Do they have human courtesy of doing their homework ? . Are they going to be so stereotyped that they do not demand answers from other persons in the revenue department. Are they not ashamed before making a demand ? . Are you also going to be a mute spectator too allowing them to emotionally humiliate us.? Why the citizens are being made the servants of the bureaucrats . . Do you understand the repercussions .. Are you not going to have a code of conduct amongst tax revenue officials that they are expected to give reply to the letters sent out by litigants. There has to be system involved where when any Government official does not give a reply to the letter the government official and his department is made to pay a compensation to the person before he send another notice/letter. why should I incur cost of litigation by hiring tax conultants and lawyers to appraoch the courts? Whether the Courts are going to run India ? If so what is the need of Sansad members, CVC, Prme Ministers, Ministers and also the President at all for which the citizens have to bear the burden.

I have been sending letters after letters to different authorities, income tax department, judiciary , CVC , sansad members, media , finance ministry , Reserve Bank of India, Institute of Chartered accountants of India , Bar Council of Gujarat and so on. Even if I spent one crore rupees , the Government of India is a living shark and vulture and it is behaving like Psunami to take away all the belongings of the citizens of the country.



Do you realize that the income tax department has extorted taxes from my wife and children without giving detailed reply ?. WHETHER THE INCOME TAX DEPARTMETN WANTS TO PLAY BUTCHER TO SMALL INNOCENT PEOPLE. ??? I HAVE SENT EMAILS EARLIER TO YOU. Your silence either shows that your Secretariat does not let you see the messages or you deliberately ignore the email or you have given directions but they are not followed up somewhere.

Sir , when the President’s Secretariat do not acknowledge and reply to the emails , how can one expect fair treatment from various departments in the country ?.

When you came to Indian Institute of Management in first week of Janurary in the evening , I did come to the IIM but the access to the function is given only to the passholders . How can I approach you in person so that I can speak face to face with you when the access is being denied ?? A female, a child or very old person can push through - but what about a person who is just 58 year old ??

How do we make you listen to the voice of common persons. what steps you have taken that Presidential directions are followed up by the concerned departments? How come the President does not tell the Judiciary to terminate the services where the President's directions are not followed by the concerned departments with absolute sense of urgency. How can you tolerate HOTI HAI CHALTI HAI ATTITUDE FOR SO LONG ??

I shall continue to send email to you with copies marked to media so that they also begin to realize that you are indeed a RUBBER STAMP PRESIDENT as observed by a student . the ball is in your court to make people feel that you are no more a RUBBER STAMP PRESIDENT BUT MAN OF ACTION AND RESULTS.

Whether , we the Indian citizens are the little fishes so that you and other leaders can feed on us by collecting taxes so that you can continue to roam from one city to another to make inaugural speeches and meeting children while the local administration is made to incur huge security expenses. Are you not trying to escape from your Rajdharma when you preach to children in lakhs but you never preach and push bureaucrats and politicians.

Do you realize that that for me - sending each email involves investment in time and considerable expense of managing internet connection taking a print out and it becomes a full time activity hardly leaving any time for any earning and the head of the family cannot show his face to his own family by his own impotency to solve the problems with the Government which never listens.

It is high time that your Excellency , pronounce a law within a week in public interest that media is compelled to allocate more space and weightage to the people problems in order to improve transparency in the administration. Most of the time there is more focus on the rich and famous and the leaders. This weightage needs to be curtailed . This is best way to understand the pulse of the people , expose the inaction of the bureaucrats such as tax officials so that chartered accountants stop doing their chamchagiris in public to such scoundrels and these scoundrels refrain from showing their faces in the society .

The President of India website need to have a section where open messages appear on internet as regards to the communication , complaints to various departments including the judiciary and the same need to be published by newspapers on daily basis referring the names/addresses/designation of the bureaucrats . Such action would make the bureaucrats, leaders, to behave responsibly and in most of the cases you may not have to attend and intervene the emails .

Tell me Mr. President , what has CVC done to my email message during the Vigilance Week ? Have they replied ???

Most of the media news papers attend to the people stories where the damage is already done but they hardly play proactive role which could prevent further damage and bitterness in the family tearing the families. Who is going to transform the system at speed of light before the nation gets destroyed.

As far as your love for children , you can ask the schools to sponsor a few children so that they can visit you and meet you in Rashtrapati Bhavan at the expense of Government of India .This would be cheaper than making the security arrangement during your visits in various cities.

Your Excellency, the change has to start with you first before you start preaching sermons to the children. Please reread the message again.

Please see that you mark a copy of detailed reply to various yahoogroups where I have marked this email . I hope that you do not want to tarnish your image for the failure on the part of the President’s Secretariat to respond to my email. You will also make CBDT CHAIRMAN TENDER APOLOGY IN WRITING TO ME FOR THE FAILURE OF THE INCOME TAX DEPARTMENT TO GIVE DETAILED REPLIES TO VARIOUS LETTERS. Even if you give me a death sentence , then also it would be beneficial to the country . You can take such course of action if at all you have GUTS TO DO THAT . At least more and more people in the country woudl be inspired to make the sacrifice like BhagatSingh in independent India

I am enclosing a copy of letter addressed to Commissioner of Income-Tax-Appeals (XVII) on 18-01=2005 and I would appreciate that you forward the following letter to the concerned authorities in the interest of natural justice to me and my family.



I am serving the letter through you to the CIT-Appeals (XVII) in case the delivery of my letter to them is being refused by the department for the reasons best known to them.



I have realized that the Government of India is not for the people but people can be looted by Dushashanas in the Income tax department stripping the citizens.



I look forward to the acknowledgment as well as action taken in the matter by your Excellency in this regard.

Respected Sir,



SUBJECT: APPEAL HEARING FIXED FOR HEARING ON 18-01-2005 FOR THE ASSESSMENT YEAR 96-97 AND 97-98 IN RESPECT OF PERSONAL AS WELL AS MY HUF ASSESSMENTS.

REFERENCE:_ MY VARIOUS LETTERS ADDRESSED TO YOU PENDING FOR YOUR KIND REPLY.

This is in reference to the above referred appeals pending before you for hearing and the notice being served to me on 11-1-2005 for fixing date of hearing today on 18-1-2005. You would appreciate that issue of such short notice is not proper on your part.
I would like to draw your attention once again that , I HAVE YET TO RECEIVE Detailed replies to my letters addressed to you from time to time. I once again request you to furnish detailed replies in this regard for the orders passed by the concerned Commissioner of Income Tax (Appeals) who passed orders against the assessing officers in case of my wife and my children.
You would appreciate that my family members have requested the assessing officer at the time of assessment proceedings to obtain documentary evidences from Dhanyushya, Jalundhwala, Kashiparekh, Shah and Shah ,etc along with recording of their statement while giving them opportunity to cross examine them. This has been not done by them . It also appears that the concerned CIT(Appeals ) who passed orders has also not done so with tacit collusion of the tax- consultant who appeared on behalf of my wife and my children before the concerned CIT-Appeals .
You would also appreciate that as I am head of my family , I am under moral obligation to protect my family members from the department officials and as I have realized that CIT –V , Mr. M.C.Katheria located in Narayan Chambers and the staff working under him has used means of coercion to demand taxes on presumption basis my using means of fear and scare. Mr. Katheria had directed that because my family members have paid , I also should pay taxes without offering legitimate reasons.
As. I have reason to feel that the orders have been passed against the orders passed by the assessing officer , I have reason to assert that the department officials are incompetent to discharge their duties effectively in the income tax department.
As the department has victimized me and my family and have suffered a lot , this is my open NON-COPERATION TO YOU TILL YOU BLOW WHISTLE AGAINST THE DEPARTMENT OFFICIALS AND THE CONNECTED CHARTERED ACCOUNTANTS AND HANDA GROUP. The way my family has suffered , I would not like other families get trampled by the high handedness of the income tax department and I have mentally accepted death because I am putting on a fight with the might for a right and just cause.
Kindly wait till the findings are made available on account of my present email to President of India.
However, as an abundant precautionary measure to protect the legitimate interest of revenue , you shall instruct the Tax recovery officer to attach the immoveable properties referred to him vide my letters addressed to him from time to time.
You would be pleased to know that CBI has filed criminal case against some of the borrowers of Global Trust Bank as per the announcement on January 3 ,2005. This particular matter involves Global Trust Bank and hence , it is necessary that you think twice before you take any adverse action against me.
Moreover, your failure to blow whistle against the senior officials of the income tax department as well as the Handa group and others would put your motives as well as your integrity under suspicion. It is your choice whether you want to jeopardize your self and your family to help the crooks in the department and connected with the Handa group.
You are free to make a free choice by listening to the voice of your conscience at a time when your mind is at rest. I look forward to your detailed reply in this regard.

I am sending copy of the letter to you so that it can be served to the CIT-APPEALS through the President of India as well as to maintain record for my constituional right to Information on necessary documentary evidence in this regard before any orders are passed by CIT- Appeals (XVII).

I am in receipt of the notice of hearing in my case for assessment years 96-97 and assessment years 97-98 fixed for hearing on 6-12-2004.



In this connection, I the undersigned humbly make to invite your Honor’s kind attention to my request letter/petition dated 24-2-2004,18-08-2004, 25-10-2004 addressed to your Honour. I hereby state that I have not received any reply in this matter. Consequently , Kindly note that it is not possible for me to appear before your good self because I have raised several critical and



relevant issues in my above referred petition letters addressed to your Honour and unless I am equipped with the clarification and reply , it will not be possible for me to defend my case and consequently, such action on your part will have the effect of violating the principals of natural justice ,which , I am sure will not like you to be instrumental to the injustice which is likely to be caused to me if the appeal is decided in my absence. Besides, the issue of GTB as well as conduct of great robber Mr. Sushil Handa is involved. Under no circumstances, you can turn a blind eye to the events.



In view of the above mentioned facts and the circumstances of the case, I request your good self to give a long adjournment in this case and favour me with the reply to my impugned petition letters dated. 24-2-2004 , 18-08-2004 and 25-10-2004.



An early reply will meet with the ends of justice.
